Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the SnapTicker mobile application and website (collectively, the "Service") provided by SnapTicker Inc. ("SnapTicker," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

Account Registration

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

Product Scanning Feature

SnapTicker's core feature uses AI-powered image recognition to identify products and their associated publicly traded companies. You acknowledge and agree that:

• Product recognition accuracy may vary and is not guaranteed
• The Service may not recognize all products or brands
• Company-ticker associations are based on publicly available data and may change
• You should verify all information before making investment decisions
• Images processed through the Service may be analyzed by third-party AI providers (OpenAI, Google Gemini)

Market Data and Information

Stock prices, financial data, and market information provided through the Service are sourced from third-party data providers (including AlphaVantage). We do not guarantee the accuracy, completeness, or timeliness of this data. Market data may be delayed by up to 15 minutes or more. You agree that:

• We are not responsible for errors or delays in market data
• You will not rely solely on our data for trading decisions
• You will verify information through official sources before investing
• Market data is provided "as is" without warranties of any kind

Third-Party Services and Links

The Service may integrate with or link to third-party services, including brokerage platforms, financial data providers, and AI services. These third-party services are governed by their own terms and privacy policies. We are not responsible for:

• The content, accuracy, or practices of third-party services
• Transactions or interactions you have with third parties
• Any losses or damages resulting from third-party services
• Changes or discontinuation of third-party integrations

Your use of third-party services is at your own risk. We recommend reviewing their terms and privacy policies before use.

Subscription and Payments

SnapTicker offers both free and premium subscription tiers. Premium features may include:

• Unlimited product scans
• Advanced analytics and insights
• Real-time market data
• Portfolio tracking and alerts
• Ad-free experience

Payment Terms

• Subscriptions are billed monthly or annually in advance
• Payments are processed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless canceled before the renewal date
• You can cancel your subscription at any time through your app store account settings
• Refunds are subject to Apple and Google's refund policies
• We reserve the right to change subscription pricing with 30 days' notice

Intellectual Property Rights

The Service, including all content, features, functionality, software, designs, logos, and trademarks, is owned by SnapTicker Inc. and is protected by United States and international copyright, trademark, and other intellectual property laws. The SnapTicker name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SnapTicker Inc. You may not use these marks without our prior written permission.

User-Generated Content

You may be able to submit content through the Service, including watchlists, notes, and feedback. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to submit your content and that your content does not violate any third-party rights or applicable laws.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding investment outcomes or financial results

We do not warrant that the Service will meet your requirements or that any defects will be corrected. Your use of the Service is at your sole risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPTICKER INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Investment losses or financial damages
• Damages resulting from errors, omissions, or delays in market data
• Damages resulting from third-party services or content
• Damages resulting from unauthorized access to your account

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless SnapTicker Inc., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your investment decisions or financial losses
• Content you submit through the Service

Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and data
• You remain liable for any obligations incurred before termination
• Provisions of these Terms that should survive termination will remain in effect

Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if they qualify.

You agree to waive your right to a jury trial and to participate in class action lawsuits. Arbitration will be conducted in Delaware, United States, and governed by Delaware law.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. We may also notify you via email or in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SnapTicker Inc. regarding your use of the Service and supersede all prior agreements and understandings.
